Terms of Service

The terms that apply when you use Datanah.

1. Your agreement

These Terms govern your access to Datanah, including its website, accounts, Free plan and Pro plan. The service provider is Datanah. By using the service, you agree to these Terms. If you use Datanah for an organisation, you confirm you can agree for that organisation.

2. The service

Datanah is a Malaysian property transaction research software service. We provide tools to search, organise and review recorded property transaction data and related calculations. We may change, maintain or discontinue features where reasonably necessary.

3. Accounts and acceptable use

You must provide accurate account information, keep your sign-in details secure, and use Datanah lawfully. Do not interfere with the service, attempt unauthorised access, scrape or extract material at scale without permission, or resell access to the service or its content.

4. Plans and payment

Datanah has a Free plan and a Pro plan. The current Pro prices appear on the Pricing page. Monthly access is planned on a recurring card basis; yearly access is planned as a one-off FPX payment with manual renewal. Checkout is not yet connected, so no payment is currently taken through Datanah. When a payment option is available, its displayed price, billing terms and applicable taxes will apply.

You may cancel a monthly Pro subscription before its next renewal; access continues until the current paid period ends. Annual access does not renew automatically through FPX; you must renew manually to continue after the paid year.

5. Content and licence

Datanah and its original software, design and analysis remain ours or our licensors'. The underlying public records remain subject to their source terms. We give you a limited, revocable, non-transferable right to use the service for your own research while you follow these Terms.

6. Data and no advice

Datanah uses published transaction data, including data made available by NAPIC. Records may be delayed, incomplete, inaccurate, differently categorised or unavailable for a particular property. Datanah is not a valuation, legal, financial, tax, investment or property advisory service. Do not rely on it as the sole basis for a purchase, sale, financing or other decision; obtain independent professional advice where needed.

7. Availability and liability

We work to keep Datanah useful and available, but do not guarantee uninterrupted, error-free or complete service or data. To the extent permitted by law, Datanah is not liable for indirect or consequential loss, or for decisions made using the service. Nothing in these Terms excludes liability that cannot legally be excluded.

8. Suspension and termination

You may stop using Datanah at any time. We may restrict or end access when an account breaches these Terms, threatens the service or other users, or when the law requires us to act. If we end a paid account without cause, we will provide a proportionate refund for unused prepaid access where appropriate.

9. Privacy

Our Privacy Policy explains how we handle personal information. The Cancellation & Refund Policy and Digital Delivery Policy form part of the terms for paid access.

10. Malaysian law and changes

Malaysian law governs these Terms. Malaysian courts have jurisdiction over disputes, subject to any rights you have to use another court or tribunal under mandatory law. We may update these Terms by posting a revised version with a new effective date. Questions can be sent through our contact page.
